If you are a business that began operations after February 15, 2020, you may still qualify for the Employee Retention Credit for both 3rd Quarter 2021 AND 4th Quarter 2021 up to $100,000.
The Taxpayer Certainty and Disaster Tax Relief Act of 2020 which was signed into law December 2020 enabled businesses that began operations during the pandemic to claim ERC. However, those businesses are only eligible for Q321 and Q421 despite what some ERC Mills are promoting. The criteria for eligibility are mostly the same but with the additional exceptions:
- Begins operations after 2/15/20
- Has <$1M average annual gross receipts in preceding calendar year
- Maximum ERC credit is $50,000 for Q321 and Q421 for a possible RSB total of $100,000
